1. Scope and Covered Brands

This Policy applies to all services, systems, and websites operated by Better The World LLC, including:

Better The World LLC is organized under the laws of the State of South Carolina, United States.

2. Governing Law

This Policy and any disputes arising from services provided by Better The World LLC shall be governed by:

•The laws of the State of South Carolina

•Applicable federal laws of the United States

International clients (including those in Canada, the United Kingdom, the European Union, Australia, Mexico, and Brazil) agree that South Carolina law governs contractual disputes unless otherwise agreed in writing.

3. AI Usage Overview

We may use artificial intelligence systems to assist in:

•Creative ideation

•Branding and marketing development

•Web design drafting

•Automation workflows

•CRM integrations

•AI-based booking or support agents

•Business directory and marketplace optimization (Effypop)

AI tools are assistive technologies only.

They are not autonomous decision-makers for final client deliverables.

4. Human Oversight Commitment

Consistent with our Human-First and Human-Centric AI principles:

•All AI-generated outputs are reviewed by a human prior to final use or delivery.

•Final creative and strategic decisions are human-directed.

•No deliverable is provided as unreviewed machine output.

•A human remains accountable for final outcomes.

5. Effypop-Specific AI Use

Effypop operates as a curated arts and culture platform combining elements of:

•An online business directory

•A freelance marketplace

•A collaborative marketing co-op

AI may be used within Effypop to:

•Assist in content drafting

•Organize listings

•Recommend businesses or creatives

•Analyze engagement trends

Effypop does not guarantee ranking placement, visibility, or commercial outcomes for listed businesses or creatives.

Listings may include user-submitted content, for which the submitting party is responsible.

6. Data Practices and Privacy Position

6.1 Data Minimization

We intentionally avoid collecting or processing:

•Protected health information (PHI)

•Sensitive financial credentials

•Special category data under GDPR

•Highly sensitive personal identifiers

Unless explicitly contracted and safeguarded.

6.2 U.S. Compliance

Our practices are designed to align with:

6.3 International Clients

7. AI Limitations

AI systems:

We do not guarantee error-free AI output.

Clients remain responsible for verifying legal, financial, and compliance-sensitive decisions.

8. Intellectual Property

Unless otherwise agreed:

•Final deliverables become the client’s property upon full payment.

•AI tools used in development do not retain ownership rights in customized outputs.

•Clients are responsible for trademark searches and regulatory clearance.

9. Ethical Safeguards

We aim to mitigate:

•Bias and discrimination

•Privacy violations

•Social manipulation

•Misinformation risks

We reserve the right to refuse projects involving:

•Deceptive AI usage

•Manipulative automation

•Unlawful activity

10. AI Chat & Booking Agent Disclosure Notice

Certain websites or services under Better The World LLC may deploy AI-powered chat agents, voice agents, or automated booking assistants.

By interacting with these systems, users acknowledge:

•They may be communicating with an AI system rather than a human.

•AI-generated responses may contain inaccuracies.

•Conversations may be recorded or logged for quality improvement and operational purposes.

•Final confirmations (such as bookings or agreements) may require human verification.

Where required by applicable law, we aim to provide reasonable disclosure that AI systems are in use.

Users should not provide sensitive financial, medical, or highly confidential information through AI chat systems unless explicitly instructed and secured.

11. Automation System Responsibility (Pro-How)

For AI and automation systems deployed for clients:

•Clients are responsible for post-deployment monitoring.

•Clients are responsible for compliance with local AI disclosure laws.

•Clients are responsible for proper system supervision where required.

We are not liable for:

•Client misuse

•Third-party modifications

•Regulatory penalties incurred by client operations

12. Limitation of Liability

To the fullest extent permitted under South Carolina law:

Better The World LLC shall not be liable for:

•Indirect, incidental, or consequential damages

•Lost profits or revenue

•Regulatory fines imposed on clients

•Third-party AI provider failures

Total liability shall not exceed the fees paid for the specific service giving rise to the claim.

13. Indemnification

Clients agree to indemnify and hold harmless Better the World LLC from claims arising out of:

•Client-provided content or data

•Regulatory violations within the client’s jurisdiction

•Unauthorized system modification

•Client misuse of AI systems

14. Dispute Resolution & Arbitration

14.1 Informal Resolution First

Before initiating formal proceedings, parties agree to attempt good-faith informal resolution for at least 30 days.

14.2 Binding Arbitration

If a dispute cannot be resolved informally:

•The dispute shall be resolved by binding arbitration.

•Arbitration shall take place in South Carolina.

•Arbitration shall be conducted under the rules of the American Arbitration Association (AAA).

•The arbitration shall be conducted by a single arbitrator.

•Judgment on the arbitration award may be entered in any court of competent jurisdiction.

14.3 Waiver of Jury Trial

Both parties waive the right to a jury trial in any dispute arising under this Policy.

14.4 Class Action Waiver

All disputes must be brought individually.

No party may participate in a class action, consolidated claim, or representative proceeding.

15. Policy Updates

We may update this Policy to reflect:

•Regulatory developments

•AI governance evolution

•Operational changes

Continued use of our services constitutes acceptance of the updated Policy.
